A Guide: How Divorce Ends

Divorce cases usually end in one of two ways: through a divorce agreement reached by the spouses or through judicial rulings by the courts. In this article, we explore these scenarios and provide insights into the methods employed to reach a comprehensive divorce agreement.

Divorce via a Divorce Agreement: A divorce agreement can be made at any stage of the divorce process. It is advisable for both parties to have separate attorneys review and amend the agreement. Negotiation between attorneys or mediated discussions can help facilitate the agreement. Mediation involves a mediator who assists the couple in reaching mutually satisfactory terms.

Compromise through Family Court Judge: In certain cases, a Family court judge may help the couple find a compromise. The judge reviews relevant documents and issues a binding decision on outstanding issues. This process reduces the time, emotional toll, and financial burden associated with prolonged litigation.

Execution of the Divorce Agreement: Once a divorce agreement is reached, it needs to be affirmed as a judgment by the court. This typically involves one hearing in the Family court, followed by affirmation in the Rabbinic court. The Rabbinic court’s affirmation is followed by the “Get ceremony,” which finalizes the divorce. This process usually consists of three court hearings.

Affirmation by the Rabbinic Court: If the divorce agreement is affirmed by the Rabbinic court, an additional hearing is required for the “Get ceremony.” This ceremony marks the official granting of the divorce.

Understanding how divorce cases conclude can help individuals navigate the process more confidently. Seeking the guidance of experienced attorneys and exploring alternative dispute resolution methods like mediation can contribute to reaching a fair and satisfactory resolution. By being aware of the available options, individuals can make informed decisions about their future.
