Understanding the Divorce Process

• Filing Complaints:

• Hire an attorney and develop a legal strategy.
• Prepare complaints (known as “Kitvei Tvia” in Hebrew) with basic information about the couple, marriage details, and desired outcomes.
• Sign affidavits affirming the truth of the statements in the complaint and grant power of attorney to the attorney.
• File the complaints in the appropriate Family and/or Rabbinic courts.

• Serving Papers and Response:

• The court serves the papers to the husband or uses a private process server.
• Once the husband is served, the divorce litigation officially begins.
• The husband has 30 to 45 days to respond to the complaints.
• Countersuits and motions may be filed by the husband, but it’s important not to be overly concerned about them.

• Court Proceedings:

• Preliminary conferences take place to address preliminary requests, encourage agreement on some issues, and set timelines.
• Evidentiary hearings are scheduled, where cross-examination and presentation of evidence occur.
• Oral or written summations may follow the evidentiary hearings.
• Finally, the court issues a written judgment.

• Reaching an Agreement:
• Most cases (over 90%) are resolved before reaching the stage of a written judgment.
• Parties often come to an agreement through negotiation or alternative dispute resolution methods.
